1. Our Commitment to You
A and D Discount Building Supplies ("A and D," "we," "us," "our") sells a mix of factory seconds, clearance, discounted, and full-price building supplies. Regardless of the price you pay or the condition a product is sold in, your rights under the Australian Consumer Law (ACL) always apply. Nothing in this policy limits, excludes, or replaces those rights.
This policy explains:
- What you're entitled to under the ACL "consumer guarantees"
- How seconds, clearance, and discounted stock are treated
- How to make a claim, and what we need from you
- Our approach to change-of-mind returns and special-order items
2. Your Rights Under the Australian Consumer Law
Under the ACL, products we sell must:
- Be of acceptable quality (safe, durable, and free from defects, taking into account the price paid and how the product was described)
- Match their description, sample, or demonstration model
- Be fit for the purpose disclosed by you or reasonably expected of that type of product
- Come with clear title and no undisclosed security interests
If a product fails to meet one or more of these guarantees, you're entitled to a remedy. The remedy depends on whether the problem is major or minor:

These rights apply automatically. They exist whether or not you ask for them, and regardless of any signage, invoice wording, or staff comments to the contrary. We cannot and do not attempt to override these rights.
3. Factory Seconds, Clearance, and Discounted Stock
Many of our products are factory seconds, freight-damaged, ex-display, or clearance stock sold at a reduced price. This doesn't reduce your ACL rights — but it does change how "acceptable quality" is assessed for that specific item.
What this means in practice:
- If a defect, mark, or fault was disclosed to you — verbally, on a tag, on a sign, in a photo, or in the product description — before you bought the item, you cannot claim a refund, repair, or replacement for that specific, disclosed issue.
- You can still claim a remedy if the product develops a different fault that wasn't disclosed, or if it fails to do what it's meant to do beyond the disclosed cosmetic or grading issue.
- Where practical, we will point out and/or tag known defects on seconds and clearance stock at the time of sale, and we recommend you inspect items carefully in-store before purchase, particularly for large or bulky building materials that are difficult to return.
Example: if a sheet of plywood is sold as a "second" due to a marked panel edge, and that edge later chips further, this isn't covered. If the same sheet later delaminates due to a manufacturing fault unrelated to the disclosed defect, you are entitled to a remedy.
4. What's Not Covered
You are not entitled to a remedy under the ACL where:
- You simply changed your mind, over-ordered, or no longer need the product
- The product was damaged by misuse, incorrect installation, or normal wear and tear
- You were told about the specific problem before buying, or it was reasonably obvious on inspection
- You used the product in a way it wasn't designed for
- The problem was caused by something other than us (e.g. a third-party installer)
5. Change of Mind Returns
Change-of-mind returns are not required under the ACL, but as a courtesy we accept them under the following conditions:
- Request made within 30 days of purchase
- Item is unused, in original/re-saleable condition and (where applicable) original packaging
- Proof of purchase provided (receipt, invoice, or bank/card statement)
- A restocking fee of up to 15% may apply on bulky, made-to-order, or special-order items
- Freight and delivery charges are non-refundable, and return freight is at your cost, unless the item is faulty
Not eligible for change-of-mind return:
- Factory seconds, clearance, and discounted stock (sold as final, unless faulty beyond the disclosed defect)
- Custom-cut, custom-mixed (e.g. tinted paint, cut timber, cut glass), or special-order products
- Products clearly marked "final sale" or "no returns" at the point of sale
6. How to Make a Claim
- Contact us as soon as you notice a problem — [phone/email/contact page link].
- Provide proof of purchase — a receipt, tax invoice, or bank statement showing the transaction. We can often look this up from your name, phone number, or order number if you've misplaced your receipt.
- Describe the issue and, where possible, provide photos — this helps us assess bulky or heavy items without requiring you to transport them unnecessarily.
- We'll assess the product and confirm the appropriate remedy. For major failures, you choose between a refund and a replacement. For minor issues, we'll usually offer a repair first.
- Approved refunds are made using your original payment method, and repairs/replacements are completed within a reasonable timeframe.
We may need to inspect the goods, or arrange for the manufacturer or supplier to inspect them, before confirming a remedy. This is standard practice and does not affect your underlying rights.
7. Delivery, Freight, and Damaged-on-Arrival Items
- Please inspect deliveries at the time of drop-off wherever possible, and note any visible damage on the delivery docket.
- If an item arrives damaged or is missing parts, contact us within 48 hours of delivery so we can arrange an inspection, replacement, or refund.
- Freight damage on items you've arranged to be collected by your own courier or transport provider is between you and that provider once the goods have left our premises in good order.
8. Manufacturer Warranties
Some products carry an additional manufacturer's warranty on top of your ACL rights. Manufacturer warranty periods and conditions (including on factory seconds, where they may differ from full-price stock) will be provided at the time of sale where applicable. A manufacturer's warranty operates alongside — and never instead of — your consumer guarantees.
